I-T launches prosecution against DKS for tax evasion, destruction of evidence

The Income Tax (I-T) department has launched a prosecution against Energy Minister D K Shivakumar for tax evasion.

Sources confirmed that the department had filed an application for prosecuting Shivakumar for tax evasion and also for destruction of evidence.

The application to prosecute Shivakumar was moved before a special court for economic offences in the city. The special court has taken cognisance of the matter and has issued summons to Shivakumar, asking him to appear before it on March 22.

The I-T department has filed the charge sheet under Section 276 C (1) of the I-T Act for tax evasion and also under Sections 201 and 204 of the IPC for destruction of evidence.

I-T sleuths had raided the premises belonging to Shivakumar in August 2017. The searches were conducted between August 2 and 5. Several teams of I-T officials had conducted searches in 66 places, including Shivakumars house in Bengaluru and an apartment in Delhi.

According to sources, the prosecution also included charges of destruction of evidence since Shivakumar tried to tear certain documents when I-T sleuths arrived at Eagleton Resort in Bidadi on Bengaluru-Mysuru Road. On the day of the raid, Shivakumar was at the resort, where he was hosting Congress MLAs from Gujarat.

Speaking to media on Thursday, Shivakumar said he had not received the copy of the summons.

“I have not received any summons from the court till today. I have stated this before and I will reiterate that if the I-T department has launched a prosecution, law will take its own course, he said.
